Germany: Federal Labour Court on the Burden of Proof in Litigation regarding Remuneration for Overtime

  • The Federal Labour Court on 4 May 2022 confirmed that in overtime proceedings, according to the German Law, employees must prove not only that they have worked overtime, but also that this has been ordered or at least approved by the employer.

  • On 8 March 2022, the Chilean Congress enacted law n. 21.431 regulating digital platforms employees’ employment contracts.
  • The law will enter into force on 1 September 2022.

Uruguay: new decree clarifies law on telework

April, 2022
  • Decree of 17 March 2022 n. 86 regulates Law 19.978 of 20 August 2021 that promotes and regulates, for the first time, teleworking.
  • It adds to the regulatory framework of this new way of working that spread rapidly because of the pandemic, clarifying certain aspects of the legislation.

Vietnam: new resolution changed overtime regulation

April, 2022
  • On 23 March 2022 the National Assembly's Standing Committee adopted Resolution No. 17on employees’ monthly, annual overtime hours in the context of COVID-19 prevention and socio-economic development”, aiming to facilitate socio-economic recovery and development from the pandemic. 
  • It increased, until 31 December 2022, the maximum monthly overtime limit and relaxed the annual restrictions on overtime currently provided for in the 2019 Labour Code.

  • On 28 December 2021, Legislative Yuan adopted the amendments of the Act of Gender Equality in Employment.
  • Amendments came into force on 18 January 2022.

Korea: Upcoming employment law changes

September, 2021
  • Employment law amendment cover minimum wage, working hours, protections for employees against wrongful disciplinary actions, new penalties for failure to adequately handle workplace harassment, new claim procedure and remedies for gender-discrimination and sexual-harassment claims, use of childcare leave during pregnancy and right to request working-hours adjustment during pregnancy.
  • These measures will go into effect later in 2021 and 2022.

Uruguay: New law on Telework

September, 2021
  • On 10 August 2021, Senate approved Law Nº 19.978 that promotes and regulates the modality of teleworking.
  • It is the first law that generally regulates this modality of work in Uruguay.
