  • It implements the 2023 Supreme Court Guideline for the Role of Indonesian Courts (“SEMA No. 3”) to be applied when settling labour disputes.

Indonesia: new Guidelines on Workplace Sexual Harassment

  • On 9 May 2023, the Minister of Manpower ("MoM") issued Decree No. 88 of 2023 on Guidelines for the Prevention of and Response to Sexual Harassment in the Workplace, updating the previous guidelines in force since 2011 (MOM Decree No. SE.03/MEN/IV/2011).
  • The Guidelines identify actions employers should take to prevent and address sexual harassment in the workplace effectively.

Indonesia: a new COVID-19 risk assessment service for enterprises

  • On 28 September 2021, a web-based Covid-19 risk assessment service has been launched by Minister of Manpower, Ida Fauziyah, Deputy Chief of Mission of the Embassy of Japan, Masami Tamura, and Michiko Miyamoto, Country Director for International Labour Organisation (ILO) in Indonesia.
  • The project, under the ILO’s Enhancing COVID-19 Prevention at and through Workplaces project funded by the Government of Japan, aims to promote job creation by enhancing enterprises’ safety measures to ensure safe and sustainable workplaces.

Germany: a new law on compulsory vaccination for health workers

  • On 10 December 2021, the Parliament passed the “Law to strengthen vaccination prevention against Covid-19".
  • By 15 March 2022, employees in clinics, nursing homes, outpatient care services and similar facilities must present proof of being vaccinated or convalescent.

  • On 5 October 2020, the Indonesian Parliament adopted the “Omnibus Bill on Job Creation” to favour investments and positively impact employment in the country.
  • The labour law component of the Bill introduces important changes for employers on minimum wages, outsourcing and temporary contracts, severance payment, unemployment and other matters.
