Mexico: New standard for telework safety and health conditions

  • On 8 June 2023, the Ministry of Labour and Social Welfare published the Official Mexican Standard NOM-037-STPS-2023 Telework-Safety and Health Conditions at Work (“NOM-037” or "Standard") in the Official Gazette of the Federation. 
  • NOM-037 states the health and safety conditions for employees teleworking across Mexico to prevent accidents and illnesses, as well as to promote a safe and healthy working environment.
  • It will enter into force 180 calendar days after its publication.

UK: New guidance on positive action in the workplace

  • On 17 April 2023, UK Government published “Positive action in the workplace: guidance for employers,” explaining how employers can help people who share a particular protected characteristic to overcome specific barriers with positive actions without unfairly disadvantaging other groups as this could amount to an unlawful ‘positive discrimination.’
  • It covers all protected characteristics, including sex, sexual orientation, age, and ethnicity.
  • It is a part of the ongoing government’s inclusive strategy to support employers in creating opportunities for underrepresented groups within their workforce.

Belgium, Germany and Netherlands agreements on taxation regime for remote workers to be extended.

January, 2022
  • Due to COVID-19, the existing agreements on the tax regime of employees working at home, instead of in the country where they should normally work, was further extend until 31 March 2022.
  • The measure aims to prevent that the employment income of cross-border employees working from home becomes fully taxable in their State of residence.

South Africa: new minimum wage target for 2022

  • On 10 December 2021, the National Minimum Wage Commission (NMWC) presented its report and recommendations on the annual review of the national minimum wage for 2022.
  • The majority of Commissioners, after considering the current economic state of the country and the impact of the COVID-19 pandemic on both employers and employees, recommends that the national minimum wage should be increased by 1,0% above inflation.

ILO launches a self-assessment method for social dialogue institutions (SAM-SDI)

  • ILO recently launched a new Self-Assessment Method for Social Dialogue Institutions (SAM-SDI) in response to requests from member States for support to strengthen their national Social Dialogue Institutions (SDIs).
  • The tool guides ILO constituents and their partners through a detailed self-assessment of their institution and devise an action plan to enhance its inclusiveness and effectiveness.
