New Zealand: Employment Relations (Restraint of Trade) Amendment Bill

  • On 22 September 2022, Labour MP Helen White introduced the Employment Relations (Restraint of Trade) Amendment Bill (Bill) to Parliament. 
  • It seeks to amend the Employment Relations Act 2000 to include a restraint of trade provision that will “prohibit the use of restraints of trade in employment agreements for lower and middle-income employees”. 
  • The Bill will also require employers of higher income employees to carefully consider whether a restraint of trade is appropriate to those employees and, if they insist on a restraint of trade, to compensate the employees for it.

First proceedings under USMCA United States-Mexico-Canada Agreement (USMCA)

  • The first two complaints using the RRLM were filed in May of this year. The American Federation of Labour and Congress of Industrial Organizations (AFL-CIO) filed a complaint against Tridonex on 10 May 2021 and the United States Trade Representative filed a complaint against General Motors (GM) on 12 May 2021.
  • On 10 August 2021, the Tridonex case ended with an agreement between the Company and the US Government.
  • On 17 August 2021, workers at General Motors plant, after an initial vote in April marred by spoiled ballots, voted to scrap their collective contract under the supervision of independent observers to guarantee a fair vote.

Mexico: the Business Coordination Council introduces tools to prevent labour disputes

  • The new trade agreement between Canada, Mexico and the USA could limit Mexican companies to export to the US or Canada because of labour disputes. 
  • The Employer’s federation CCE, provided tools for Mexican business to prevent this from happening.
