India: El Tribunal Superior se pronuncia sobre la cuestión de la existencia de una relación trabajador/empleador

  • En septiembre de 2022, en el caso de Kaushal Kishor Singh v/s M/S Sita Kouni World Travel India Limited (Solicitud de auto judicial c) 11631 de 2008), el Tribunal Superior de Delhi abordó la cuestión de la distinción entre autónomo y empleado.
  • El Tribunal definió a un «autónomo» como una persona que actúa de forma independiente, sin estar afiliado a una organización, al vender sus servicios y sus competencias a diferentes empleadores durante un período determinado, con la capacidad de elegir los encargos o proyectos.

Australia: new decisions on the status of employee or contractor

  • On 9 February 2022, the High Court of Australia confirmed in two different decisions that, determining whether a worker is an employee or independent contractor, the most important elements are the written agreement and the contractual terms.
  • It also confirms that the Court is overtaking the multi-factorial test applied in the past in this kind of decisions.
