Fourteen Governments signed a joint statement to improve seafarers and shipowners’ conditions in Covid-19 times

  • Covid-19 crisis stranded seafarers and deteriorated safety in the maritime sector.
  • The joint statement acknowledged the need to change crew despite the travel restrictions and indicated ways to overcome this problem.
  • To date the situation has not improved.

New Law on licensing for private employment agencies in South Australia

  • In July 2020, the amended Labour Hire Licensing Act entered into force in South Australia.
  • The amendments narrow the licensing needs for staffing (labour hire) companies to specific sectors and businesses.

Canada: Enhanced labour inspection and financial support for employers in the agricultural sector

August, 2020
  • Employers of temporary foreign workers in Canada are required to comply with the Quarantine Act and respect the mandatory 14-day quarantine period upon entry in Canada
  • The quarantine period must be paid to employees. However, the government announced a financial support to employers up to CAD $1,500 per temporary foreign worker to cover employee pay during the mandatory quarantine period and other associated costs
  • The government enhanced labour inspection for employers in agriculture

EU Court decision on data protection “Schrems II”

  • In July 2020, a significant decision on data transfer concerning the General Data Protection Regulation (GDPR) was made by the Court of Justice of the European Union
  • This decision could potentially block the transfer of data between a country of the European Union and a third country, including the US

Denmark: change in legislation makes the job sharing scheme more flexible

  • New rules are adopted to make the Danish job sharing scheme more flexible
  • The regulation was followed by local and/or sectoral agreements  

Brazilian Supreme Federal Court issued a preliminary decision questioning the nature of Covid-19 as an occupational disease

  • The Federal Supreme Court did not bring clarity on this issue and in any case its decision was preliminary
  • The previous legislation on the recognition of occupational diseases remain

France gets rid of a EUR10 tax on a short term contracts

Germany: Labour Court decision on video surveillance for distance monitoring during Covid-19

  • On 24 April 2020, the Labour Court of Wesel, a city of the North Rhine-Westphalia, issued a decision on the use of specific devices to permanently monitor the behaviour of employees to prevent the spread of Covid-19.

Turkish social partners joint statement on measures to facilitate the normalisation process

  • Social partners requested the government to extend the short-term working allowance scheme until the end of 2020.
  • They also suggested that businesses paying the wage differences between short-term and normal wages should be provided more incentives and exemption of income tax

Sri Lanka tripartite agreement on the payment of wages on a pro-rated basis

  • On 4th May 2020, the Sri Lankan social partners and the Ministry of Skills Development, Employment and Labour Relations reached a tripartite agreement for “Pro-rate Wages Based on Varied Levels of Deployment”.
  • This agreement paves the way to further discuss and solidify schemes such as ‘job sharing’.

US legislations on employers’ liability protection clauses in case of Covid-19 could become a federal issue

  • If this regulation is adopted, employers’ liability would be limited to acts of gross negligence or intentional misconduct.
  • The law would have retroactive effect from 2019 and be in force until 2024.

France: temperature checks before entering the workplace are not permitted

  • Health checks with data collection are prohibited
  • Health checks with no additional collection of data are allowed, but the employee can refuse them

Costa Rica: Strike regulation goes through an important reform

  • The new legislation defines legal strike as opposed to illegal strike, and sets the conditions for legality.
  • It also distinguishes between essential services and services of transcendental importance and many other important specificities.

ILO Global Summit on “COVID-19 and the World of Work - Building a better future of work”: outcome of discussions and main messages

  • Employers’ representatives presented 10 key messages articulating the private sector needs and perspectives for a fast, sustainable and inclusive recovery.
  • Private sector led economic growth, a conducive environment for businesses development and resilience; tackling informality with innovative approaches; investment in skills and the role of the private sector within the multilateral system were highlighted as particularly relevant.
  • Workers’ representatives expressed their 4 priorities, mainly focusing on extended health and safety and social protection.
  • Governments stressed on the value of the Centenary Declaration as the framework for the recovery.

Italy: fixed-term contracts can be renewed without specifying the reason until 30 August 2020

  • These contracts offer good guarantees and safeguards compared to other forms of work, ranging from bogus self-employment to illegal work.
