Netherlands: The Equal Opportunity in Employment Bill rejected in Senate

  • On 14 March 2023, the Dutch House of Representatives passed the "Supervision of Equal Opportunities in Recruitment and Selection Bill," which aims to address and reduce employment discrimination, especially on the basis of origin, gender, race, colour, age, religion, sexual orientation or disability.
  • On 12 March 2024, the discussion around the bill continued in the Dutch Senate, building on the plenary debate initiated on 27 February 2024.A critical vote and accompanying motions took place on26 March 2024 and and the Bill was not adopted in the Senate after a majority voted against it.

Netherlands: Consultation on the Legislative Proposal ‘Clarification of Assessment of Employment Relationships and Legal Presumption'

  • In April 2023, the Dutch Cabinet proposed a bill (Clarification of the Evaluation of Employment Relationships and the Legal Presumption) to clarify the legal assessment of employment relationships (when work must be performed as an employee and when it can be performed as a self-employed person). 
  • On 6 October 2023, the Minister of Social Affairs and Labour opened the internet consultation on the legislative Proposal. During this time, interested parties were invited to comment and propose amendments. The consultation ended on 10 November 2023.
  • The Proposal is expected to enter into force on 1 July 2025.

Netherlands: Senate rejects Work Where You Want Bill

  • On 26 September 2023, the Dutch Senate rejected the 'Work Where You Want Act,' a year after the Dutch parliament passed it by 37 votes to 38
  • The bill aimed to provide employees with greater flexibility regarding choice of workplace within the EU, working from home or another work location.
  • The current Flexible Working Act will continue to apply.

Netherlands: CO2 reduction from work-related mobility of persons was estabilished

  • The Environmental Planning Act, will come into effect on 1 January 2024.
  • It includes the reporting obligation for work-related mobility of persons, which is plan of the country’s agreement to reduce CO2 emissions.
  • As of 1 January 2024, organisations with 100 or more employees, who offer them a mobility facility (a financial allowance, reimbursement for public transport, or vehicle), are obliged to report on the business traffic and commuting.  Employers with less than 100 employees can report voluntarily.

  • On 5 April 2023, the European Commission published the 2022 annual report on intra-EU labour mobility, which identifies trends in the free movement of workers.
  • The 2022 edition focuses on cross-border workers in the EU and EFTA, on the one hand, and mobility of persons with specific occupations.

Netherlands: New legislation on remote work

  • On 05 July 2022 the Dutch House of Representatives (Tweede Kamer) approved a bill that estabilishes home working as a legal right, making the Netherlands one of the first countries to grant remote working flexibility by law.
  • The bill needs the approval from the Dutch senate before its final adoption.
